Overtime pay and night differential: the quick answer
Overtime on an ordinary working day is paid at 125% of your hourly rate for every hour beyond eight, and overtime on a rest day, special day or regular holiday is paid at the rate for that day plus 30%. Night shift differential is at least an extra 10% of your hourly rate for each hour you work between 10 PM and 6 AM, and when overtime falls in those hours, the 10% is added on top of the overtime rate (137.5% on an ordinary day).
These are minimums under Articles 86 and 87 of the Labor Code. Your contract, company policy or collective bargaining agreement (CBA) can give you more, but not less.
How do you compute overtime pay? (5 steps)
- Start with your basic daily wage. Use your cash wage only, without deducting the value of meals or lodging the company provides (Labor Code Art. 90).
- Get your hourly rate: daily wage ÷ 8. If you are paid monthly, ask HR how your daily rate is derived from your monthly salary, because that depends on your work schedule.
- Know what kind of day it is: ordinary working day, rest day, special non-working day, regular holiday, or a combination.
- Count your hours. Overtime hours are hours worked beyond eight in a day. Night hours are hours actually worked between 10 PM and 6 AM.
- Multiply each group of hours by the hourly rate and the right percentage from the table below, then add everything up.
The formulas
- Ordinary-day overtime: hourly rate × 125% × overtime hours
- Rest day or special day overtime: hourly rate × 130% × 130% × overtime hours (169%)
- Regular holiday overtime: hourly rate × 200% × 130% × overtime hours (260%)
- Night shift differential (ordinary day): hourly rate × 10% × night hours, on top of your regular pay (110% in total)
- Night-shift overtime (ordinary day): hourly rate × 125% × 110% × overtime hours (137.5%)

Percentages are of your hourly rate. The peso column uses a sample ₱700 daily wage (₱87.50 an hour), for illustration only.

Worked examples at a ₱700 daily wage
All examples use a sample basic daily wage of ₱700, so the hourly rate is ₱700 ÷ 8 = ₱87.50. Check your own payslip with your actual rate.
- Day shift with 2 hours overtime (ordinary day). You work 8 AM to 5 PM with a one-hour lunch break, then stay until 7 PM. Overtime: ₱87.50 × 125% × 2 = ₱218.75. Pay for the day: ₱700 + ₱218.75 = ₱918.75.
- Graveyard shift, no overtime. You work 10 PM to 7 AM with an unpaid one-hour meal break at 2 AM. You work 8 hours, and 7 of them fall between 10 PM and 6 AM. Night differential: ₱87.50 × 10% × 7 = ₱61.25. Pay for the shift: ₱700 + ₱61.25 = ₱761.25.
- Mid shift that runs into overtime past 10 PM. You work 2 PM to 11 PM with a one-hour meal break, then stay until 1 AM. One regular hour (10 to 11 PM) gets night differential: ₱8.75. The two overtime hours are night hours: ₱87.50 × 137.5% × 2 = ₱240.63. Pay for the day: ₱700 + ₱8.75 + ₱240.63 = ₱949.38.
- Overtime on a regular holiday. On Bonifacio Day (November 30, a regular holiday in 2026), you work 8 hours plus 2 hours overtime. First 8 hours: ₱700 × 200% = ₱1,400. Overtime: ₱87.50 × 260% × 2 = ₱455. Pay for the day: ₱1,855.
- Overtime on your rest day. Each overtime hour is ₱87.50 × 169% = ₱147.88, on top of 130% for your first 8 hours (₱910).
Who is entitled to overtime pay and night differential?
Most private-sector rank-and-file employees are covered. Under Article 82 of the Labor Code and the DOLE handbook, these rules do not cover:
- government employees;
- managerial employees, and officers or members of the managerial staff;
- field personnel whose hours cannot be determined with reasonable certainty;
- members of the employer’s family who depend on the employer for support;
- kasambahay and others in the personal service of another; and
- workers paid by results (for example, by piece, task or commission), as set by DOLE rules.
For night shift differential, the Omnibus Rules also exclude retail and service establishments that regularly employ not more than five workers.
Rules that trip up payslips
- Undertime does not cancel overtime. Your employer cannot offset hours you were short on one day against overtime on another day (Art. 88).
- Emergency overtime is still paid. Article 89 lists cases when an employer can require overtime, such as a declared emergency, preventing loss of life or property, urgent repairs to machines, and preventing loss of perishable goods. Those hours are still paid at overtime rates.
- Better deals win. A CBA or company policy can set higher overtime rates, and those apply instead of the legal minimum.
- Overtime and night pay are not part of your 13th month pay unless your contract, CBA or company practice treats them as part of basic salary. Our 13th month pay 2026 guide explains the computation.
What if your overtime or night pay is wrong?
Compute it with the steps above, list the dates and hours, and raise it with HR or payroll first. If it is not fixed, call the DOLE hotline at 1349 or file a Request for Assistance under the Single Entry Approach (SEnA) through NCMB or DOLE ARMS.

Frequently asked questions
How much is overtime pay per hour in the Philippines?
At least 125% of your hourly rate on an ordinary working day. On a rest day or special day it is 169%, and on a regular holiday it is 260% (DOLE handbook; Labor Code Art. 87).
How much is night differential?
At least 10% of your hourly rate for each hour worked between 10 PM and 6 AM. At ₱87.50 an hour, that is ₱8.75 extra per night hour (Labor Code Art. 86).
Do I get both overtime pay and night differential?
Yes, if you are covered. Night overtime on an ordinary day is the overtime rate plus 10% of it: 125% × 110% = 137.5% of your hourly rate (Omnibus Rules, Book III, Rule II, Sec. 3; DOLE handbook).
Is night differential computed on holidays too?
Yes. The 10% is based on the rate for that day, so a night hour on a regular holiday is 220% of your hourly rate, and 143% on a special non-working day.
Can my employer make me work overtime?
Article 89 of the Labor Code lists specific cases, such as emergencies and urgent work to prevent loss or damage, where overtime can be required. In all cases, overtime hours must be paid.
Are overtime and night differential included in 13th month pay?
Not by default. DOLE’s guidelines leave overtime, premium, night differential and holiday pay out of “basic salary” unless an agreement or company practice includes them.
